When reading our terms and conditions if the text you are reading reads: "us", "our", "ours" or "we" the text you are reading refers to FX Pro Design™ and FX Pro Audio and Design

"We", "us", "our" or "ours “means FX Pro Design™ / FX Pro Audio and Design which is a trading name of FX Pro Design™ / FX Pro Audio and Design.

"I" or "you “mean the person using the website.

When engaging our services, you acknowledge and accept these Terms and Conditions as the basis for any contract between us (FX Pro Design™), and agree that they take precedent over any other terms and conditions, express or implied, and regardless of your own general practice in conducting similar agreements under your own Terms and Conditions.

I agree Information supplied in web pages has been prepared with care and is accurate to the best of our knowledge, this information being honest, decent, and legal from the date of creation.

I agree in the event of a dispute regarding content or images given to any FX Pro Design™ designer/designers I agree that the person or persons responsible in giving any images or content for any company or companies website/websites are responsible for directing how any content or images can be used I also agree the person/persons responsible in giving content or images to us they and only they are free to redirect us to use any images or content they have given us for any project of their choice.

I agree in the event of a dispute regarding content or images given to us for use for any company/company’s website I agree the content you have provided is yours and free for us to change optimise copy edit reconstruct or use for any purpose that may or may not benefit you or your company or companies project/projects now or in the future.

I agree in the event of a dispute regarding copyright of any customer or customer’s website all designs designed by us remain the property of FX Pro Design™.

I agree in any dispute regarding any customer or customer’s requirement of copyright of any customer or customer’s website designed by us I agree that I will have to request copyright rights of required website before any work will or has been carried out by designer or designer’s.

I agree to pay a 50% deposit before any worked is carried out on any website, this is to ensure I not only have web space and a domain name paid for but also to ensure I agree and are prepared to pay the closing balance before work is handed over and classed as officially complete.

I agree in the event of a dispute regarding payments made to us via cheque if any cheque you have paid to us returns unpaid by our banks you understand that you will be charged £27.98 for your unpaid cheque and you will be charged £1.79 daily for any days the amount is not paid.

I agree in the event of a dispute regarding completion or collection of customer/customers finished work i understand that If FX Pro Design™ request I will have to agree to a completion date before any work will be carried out by FX Pro Design™ and once I have agreed to a completion date or agreed FX Pro Design™ Designers have completed your project I understand that I will be charged £27.98 if i do not collect the work I agreed is finished and ready to be picked up within 7 days of agreed completion date or agreement that work/ project is complete I also understand I will be charged £1.79 daily for any days after agreed completion date if work/project has not been collected 8 days and every day after agreed completion date.

I agree in the event of a dispute regarding domain renewals if you request FX Pro Design™ to renew your domain name we will renew you domain immediately upon request you will then have seven days to pay the domain renewal amount if you do not pay the domain renewal amount before your seven day grace we will charge you £1.79 daily until the domain renal amount has been paid.

I agree in a event of a dispute any customer or customer’s not paying an outstanding balance once a customer or customer’s website has been completed we hold the right to not release any design or site work until full payment has been received and cleared in a FX Pro Design™ account or a FX Pro Design™ designers account and also we reserve the right to take all content and design structure of any customer or customer’s website off the internet until full payment has been placed and cleared in FX Pro Design™ account.

I agree in the event of a dispute arising concerning all exclusive update packages given exclusively to any
customer or customer’s we hold the right to change or altered any update package at anytime by FX Pro Design™

1.3
I agree that in an event of a dispute arising concerning FX Pro Design’s terms and conditions i agree once i have contacted FX Pro Design™ and requested any work to start i agree that from the start date i agree to all and any terms and conditions set by FX Pro Design™.

I agree in the event of a dispute regarding bulk updates (i.e. changing the shape of a customer or customer’s website adding over 10 images to a customer or customer’s website or over 3 web pages of text all customer or customer’s must pay any labor charge quoted by FX Pro Design™.

I agree In the event of a dispute arising from the use or contents of www.fxprodesign.co.uk, we and you the user, agree to exclusively accept the jurisdiction of the courts of England and Wales.

I agree no credit will be given to any customer/customers.

FX Pro Design™ are not responsible for any guides left on any customer/customers graphic design documents before or after print.

I agree I may download or print selections of if only used for personal information and not for reproduction. Except where stated the text, graphics, and information of the web site are the copyright of FX Pro Design™. Copying and storage of for permanent use or incorporation and reproduction whether for new media or paper use is strictly prohibited.

I agree if we request you to sign any customer or customer’s Terms and Conditions agreement before any work is carried out on any web site i agree to all Terms and Conditions set by FX Pro Design™ within and out of the project date.

2.0
All 28 day update packages listed on FX Pro Design™, once purchased you have 28 days to use up your entire
update package selected.

2.1
I agree in the event of a dispute arising regarding yearly update packages once any yearly package has been selected you agree you will be legally bound to pay FX Pro Design™ the full amount for the selected update package failing to make payment once package has been selected and activated (worked on) FX Pro Design™ reserve the right to suspend your website and charge your company £27.98 for any late payment and £1.79 daily until the balance has been paid.

2.2
If we send you a 7 day quote/invoice this will be a binding agreement that FX Pro Design™ will provide a finished
product, and in so doing your company will be legally bound to pay FX Pro Design™ the full amount as stated,
within 7 days of being issued to your company. The quote/invoice received will fully outline these terms and conditions, and any failure to meet these terms in full to FX Pro Design™ will be charged £2.79 per day - until the entire balance has been paid in full.

2.3
I agree in a event of a dispute regarding any website preview work FX Pro Design™ choose or choose not to use on our portfolio website preview pages i agree that FX Pro Design™ reserve the right to show or not show any work we have started created or finished on our website preview pages.

2.4
I agree in the event of a dispute regarding business exchange contracts with FX Pro Design We reserve the right to cancel any business exchange contract for any breach of conditions made between you and FX Pro Design any business exchange contract made between you and FX Pro Design will result in FX Pro Design Admin cancelling all contract conditions and you/your company will have to pay any outstanding balance for any work done by FX Pro Design.

I agree in a event of a dispute in which i have paid for any project balance in full i agree that the project that i have paid for is closed and i also i agree that no further work is needed to be done to the project i have paid for.

I agree if i am a customer(s) of FX Pro Design™ I agree if i have signed a prepared specification sheet i agree to these and any terms and conditions set or provided by us.

I agree if i am a customer(s) of FX Pro Design™ if i the customer(s) has paid any deposit for any project i agree to these and any terms and conditions provided or set by us.

2.8
I agree if i am a customer(s) of FX Pro Design™ I agree if i the customer(s) has paid in full i agree to these and any terms and conditions set or provided by us.

2.9
I agree if i am a customer(s) of FX Pro Design™ I agree if i the customer(s) is requesting a quote from us i agree to these and any terms and conditions set or provided by us.

3.0
I agree in a event of a dispute regarding discounts given to any customer for any project or service(s) provided by FX Pro Design We reserve the right to remove all discounts from any project service or package invoice(s) sent if you cannot pay the amount due to FX Pro Design within 4 weeks of original invoice date.

3.1
I agree if i am a customer(s) of FX Pro Design™ I agree in a event of any dispute FX Pro Design™ reserve the right to change any and all terms and conditions at anytime.

3.2
I agree If i am a customer(s) of FX Pro Design™ in the event of any dispute regarding package discounts if FX Pro Design gives any discounts for any packages all discounts will expire in 4 weeks of first discount offer date.

3.3
I agree If i am a customer(s) of FX Pro Design™ and in the event of any dispute regarding website or email hosting cancellations i agree if i cancel my website or email hosting before FX Pro Design email or website hosting contract expires i will be charged a cancellation fee of £58.99 If i cancel my website or email hosting after my website or email hosting date has past (expired) but still have not paid FX Pro Design for the previous usage of our website or email services you will be charged 58.99 for a late service charge and £1.79 per day for every day until your original website or email hosting amount has paid.
